KiQ Limited, Ireland
KiQ Mail Terms of Use
These Terms of Use ("Terms") are the agreement between you and KiQ Limited ("KiQ", "we", "us", "our") for KiQ Mail. Please read them together with the KiQ Mail Privacy Policy, which explains how we handle personal data.
You accept these Terms when you tick "I agree to the Terms of Use and the Privacy Policy" and press Accept, or when you buy a plan. If you do not agree, please do not use KiQ Mail.
KiQ Mail is software owned by KiQ Limited, Ireland.

1. Who we are
KiQ Limited is a private company limited by shares, registered in Ireland under company number [CRO number], with its registered office at [registered address]. Our VAT number is [VAT number]. You can reach us by email at hello@kiqmail.app.
2. The short version
- KiQ Mail brings your mailboxes into one app, with KiQ AI, a calendar, contacts and footers. Your email itself stays with your mail provider.
- We work hard to keep KiQ Mail reliable, but we cannot promise that every email is fetched, synced, sent, delivered or kept. Keep your own backups of anything important.
- KiQ AI can be wrong. Check summaries, drafts and suggestions before you rely on them or send them. You are responsible for every email sent from your mailboxes, including automatic replies you switch on.
- A paid plan renews until you cancel. Cancelling takes effect at the end of the period you have paid for.
- Our liability is limited as section 19 explains, but nothing in these Terms takes away the rights that consumer law gives you.
The rest of these Terms say this in full. If anything in this summary seems to differ from the sections below, the sections below apply.
3. Words we use
- "KiQ Mail" or "the Service" means the KiQ Mail web app at app.kiqmail.app (also inside KiQ Hub), the KiQ Mail apps for iPhone, iPad, Mac and Android, the website kiqmail.app, and the servers and features behind them.
- "Mailbox" means an email account you connect to KiQ Mail, such as an account at your mail provider, a mailbox on your own domain or a @kiqmail.net mailbox.
- "Your content" means everything you or your mailboxes put into KiQ Mail: emails, attachments, contacts, calendar events, notes, footers, pictures, settings and instructions, and what KiQ AI produces for you.
- "KiQ AI" means the artificial intelligence features in KiQ Mail, including the KiQ AI+ reasoning tier and the KiQ AI Agent.
- "Consumer" means a person who uses KiQ Mail mainly for purposes outside their trade, business, craft or profession. "Business user" means anyone else.
4. Who can use KiQ Mail
- You must be at least 16 years old. If you are under 18, a parent or guardian must agree to these Terms for you and to any payment.
- You sign in with your KiQ ID, the sign-in service for all KiQ apps. Your KiQ ID has its own Terms of Use and Privacy Policy. Keep your sign-in details safe and do not share them. You are responsible for what happens in your account, unless it happens because we failed to protect it. Tell us at once if you think someone else is using your account.
- If you use KiQ Mail for a business or another organisation, you confirm that you may accept these Terms for it. "You" then means you and that organisation.
- One account is for one person. Family & Team plans, which are planned but not yet open, are meant to let several people share a plan, each with their own account.
- You may not use KiQ Mail where the law forbids it, or if you are subject to sanctions that forbid us to serve you.
5. What KiQ Mail does
- KiQ Mail is an email client. It connects to mailboxes that you own or are allowed to use, with the sign-in details you give us, and lets you read, write, organise and search your email in one place.
- Features include a unified inbox, email footers with your logo and a "Save contact" vCard link, contacts with contact sharing by QR code and link, a calendar, notes, notifications, offline mail on your devices, sending later, reminders, clean-up tools and KiQ AI. Which features you have depends on your plan, as section 6 explains.
- Some features differ between the web, iPhone, iPad, Mac and Android.
- Emails you send from KiQ Mail carry a small "Sent with KiQ Mail App" line under your footer, which you can switch off for each mailbox in Settings.
- We keep improving KiQ Mail, so features can change. Section 15 explains how we handle changes.
6. Plans, the free trial and the KiQ AI allowance
Free trial. When you first sign in, you get a free trial of 14 days with one mailbox and a smaller monthly KiQ AI allowance. The trial needs no payment details and does not turn into a paid plan by itself. When it ends, you need a paid plan to keep using KiQ Mail.
KiQ Mail. €3 per month or €31 per year. Up to 3 mailboxes, a monthly KiQ AI allowance and the KiQ AI tools for summaries and briefs, writing and improving emails, turning emails into calendar events and notes, and cleaning up junk and unwanted email.
KiQ Mail Pro. €6 per month or €54 per year. Up to 10 mailboxes, a larger monthly KiQ AI allowance, everything in KiQ Mail, and in addition the KiQ AI+ reasoning tier, a KiQ AI Agent for each mailbox (analysis of new email, prepared draft replies, a daily digest and meeting times), automatic replies that you can switch on, and the connection that lets KiQ AI+ agents work with your mailboxes. "KiQ AI+" in KiQ Mail Pro means these features inside KiQ Mail. It does not include a subscription to the separate KiQ AI+ app, which has its own plans and terms.
KiQ Mail Family & Team. Coming soon. We are working on a plan for families and teams, which we plan to offer with powerful KiQ Hub Office tools included. It is not sold yet. We will publish its price, features and terms before it is offered, and nothing about it is promised until then.
Features on every plan. Features that do not use KiQ AI, such as mailboxes, footers, vCards, contacts and contact sharing, the calendar, offline mail and notifications, are part of every plan. Their main limit is the number of mailboxes.
Prices. Prices are in euro and include VAT. The price that applies to you is the one shown when you buy. If a price is shown by an obvious mistake, we may cancel the purchase and refund you in full.
The KiQ AI allowance.
- Each plan includes a monthly amount of KiQ AI use, measured in units of AI processing. Settings shows how much you have used in the current month.
- The allowance renews on the first day of each calendar month (UTC). Unused allowance does not carry over.
- Some tools, such as the KiQ AI+ reasoning tier, use more of the allowance than others.
- When the allowance is used up, the KiQ AI tools pause until it renews or until extra AI is added to your account. Everything that does not use KiQ AI keeps working.
- The meter is our best measure and may take a short time to update.
- We may also give you extra AI as a gift or promotion. Extra AI does not expire while you have your account, cannot be exchanged for money and ends when your account is deleted.
Fair use limits. To keep KiQ Mail safe and working for everyone, we use technical limits, for example on how many emails a @kiqmail.net mailbox may send per day, how many automatic replies the KiQ AI Agent sends, and how often some requests can be made. They are set so that normal personal and business use stays within them.
Plans from other KiQ services. If your KiQ Mail access comes with a KiQ Hub plan, or was given to you by us for a set time, the payment terms of that plan or offer apply to it. These Terms still apply to your use of KiQ Mail.
7. Buying, renewal and cancelling
- Where plans are sold. Paid plans are sold only on our website (kiqmail.app and app.kiqmail.app). Payments are handled by our payment provider, Stripe. We never see or store your full card number. The KiQ Mail apps for iPhone, iPad, Mac and Android do not sell plans.
- The contract. Your purchase is complete when we confirm the payment on screen. You also receive a receipt by email.
- Automatic renewal. Your plan renews automatically at the end of each month or year, for the same length of time and at the price that then applies, until you cancel. Each renewal is charged to your payment method at the start of the new period. Where the law requires it, we remind you before a yearly plan renews.
- Cancelling. You can cancel at any time in Settings › Subscription on the web, or by writing to us. Cancelling takes effect at the end of the period you have already paid for. You keep your plan until then, and you are not charged again. Deleting your account also cancels your plan.
- Changing plans. You can switch between monthly and yearly, or between KiQ Mail and KiQ Mail Pro, in Settings › Subscription on the web. Any price difference is shown before you confirm.
- Failed payments. If a payment fails, we may try again. If it is still unpaid 3 days after the end of the period, the paid features stop until the payment succeeds. Your email at your mail provider is not affected.
- Price changes. If we change the price of your plan, we tell you at least 30 days before the new price applies to you. It applies from your next renewal after that notice. If you do not agree, you can cancel before then.
- Refunds. Payments are not refundable, except under your right of withdrawal (section 8), under your legal rights when the Service is faulty (section 18), or where these Terms say you get money back (sections 15, 16 and 21). In particular, if you cancel a yearly plan after the withdrawal period, it stays active until the end of the year and the rest of the year is not refunded.
- Referral credit. If we offer credit for inviting friends, the rules shown with the offer apply. Credit can only be used for KiQ subscriptions, cannot be paid out, ends when the account is deleted and is removed if it was earned through self-invites, fake accounts or other abuse.
- Business purchases. If you buy as a business with a valid VAT number, VAT may be handled as shown at checkout, for example by reverse charge. You are responsible for giving correct business and tax details.
- App stores. If we later sell plans through the App Store or Google Play, those purchases follow the store's billing and refund rules, and we will update these Terms first.
8. Your right of withdrawal (consumers in the EU and the EEA)
- 14 days. If you are a consumer in the European Union or the European Economic Area, you may withdraw from a new paid plan within 14 days of buying it, without giving a reason. Consumers in the United Kingdom have similar rights under UK law.
- Starting at once. KiQ Mail is a digital service that starts as soon as you buy. When you buy, you expressly ask us to start the Service during the withdrawal period, and you acknowledge what that means, as explained below.
- If you withdraw. We refund what you paid, minus an amount in proportion to the time your paid plan was active before you told us you are withdrawing. We refund within 14 days of receiving your notice, to the payment method you used.
- When the right ends early. Where the law allows it, you lose the right of withdrawal once supply has started, if you gave your express consent to immediate supply and acknowledged that you would lose the right. This applies to digital content supplied at once, such as a pack of extra AI if we offer one, and to a service that has been provided in full. Extra AI that you have already used cannot be returned.
- Renewals. The 14 days run from your first purchase of a plan. An automatic renewal of the same plan does not start a new withdrawal period, as far as the law allows.
- How to withdraw. Send us a clear statement, for example by email to hello@kiqmail.app. You may use the model form in Annex 1, but you do not have to. It is enough to send your statement before the 14 days have passed.
9. Your email: what we do and what we cannot promise
KiQ Mail is a client. Your email lives with your mail provider (or, for a @kiqmail.net mailbox, with our email hosting provider). KiQ Mail connects to it and keeps working copies on our servers and your devices so your mail opens fast, can be searched and can be read offline. Your mail provider's own terms and limits also apply.
What we cannot promise. We use reasonable care and skill, but email depends on many systems we do not control. To the extent the law allows, we do not promise that KiQ Mail will:
- fetch, sync, show or keep every email, or do so on time;
- send or deliver every email, deliver it once only, or keep it out of a recipient's junk folder;
- send an email you scheduled with Send later at the exact time, or at all;
- show every notification, reminder or new-mail alert, or show it on time;
- keep your devices, your mail provider and KiQ Mail perfectly in step at every moment.
Delays, gaps, duplicates and failures can happen, for example because a mail provider is down, limits or blocks access, a password or app password changes, the internet connection fails, a device is off or low on storage, an error occurs in our software or a provider's, or we are doing maintenance.
Important or urgent email. Do not rely on KiQ Mail as your only way to receive or send email that is urgent or has serious consequences, such as legal deadlines, payment instructions, safety or medical alerts. Check your mail provider directly when it matters.
Copies and storage.
- To save space, we may drop the formatted (HTML) version of older emails that have not been opened for a while and keep their text. When you open such an email, KiQ Mail fetches it again from your mail provider if it is still there.
- Attachments are fetched from your mail provider when you open them.
- If an email is deleted at your mail provider, it may also disappear from KiQ Mail.
- Copies kept on your devices for offline use can be out of date until the device connects again.
What you do in KiQ Mail is real. Moving, archiving, deleting, flagging or marking email as read in KiQ Mail does the same in your mailbox at your mail provider and in your other mail apps. Your mail provider may empty Trash or Junk by its own rules. "Delete permanently" cannot be undone. Some actions can be undone for 30 minutes only.
Automation you switch on. Some tools act for you once you set them up: clean-up of junk and unwanted email that you confirm, automatic clean-up of one-time code emails, unsubscribe requests, reminders, Send later, and the KiQ AI Agent with its drafts and automatic replies. They act on your behalf, as you set them, and they can misjudge an email. Check your settings, and switch a tool off whenever you want.
Your backups. We do not keep backups of your email, contacts, calendar, notes or footers for you. Our technical backups exist only to restore the Service after a failure, are kept for a short time and cannot be used to restore your own data on request. Keep copies of anything important, for example at your mail provider or by exporting contacts and calendars where the app offers it.
@kiqmail.net mailboxes.
- An eligible paid plan may include one @kiqmail.net mailbox (1 GB) while we offer it. It is hosted by our email hosting provider and has a daily sending limit.
- If your paid plan ends, the mailbox stays readable for 30 days, is paused after that, and is deleted 90 days after the plan ended. Renewing before then restores it. The address stays reserved for you for up to one year after deletion.
- We may refuse or change an address that is offensive, misleading or infringes someone's rights.
- Everything in this section applies to @kiqmail.net mailboxes too.
10. KiQ AI and the KiQ AI Agent
What KiQ AI does. Depending on your plan and your settings, KiQ AI can summarise emails and conversations, write and improve drafts, suggest replies, sort and prioritise email, find junk and newsletters to clean up, help you unsubscribe, turn emails into calendar events and notes, and, with KiQ Mail Pro, analyse new email for each mailbox, prepare draft replies, propose meeting times, send automatic replies you switch on, and let KiQ AI+ agents that you connect work with your mailboxes.
AI can be wrong. KiQ AI uses AI models that produce answers by predicting likely words. Even when an answer sounds certain, it can be wrong, incomplete, out of date or invented. KiQ AI can misread an email, its tone or its intent, pick the wrong date, time, amount or recipient, miss an important email, treat a wanted email as junk, or suggest a reply that is not right for the situation.
You review before you rely. You agree to:
- check a summary against the original email before you rely on it;
- read every draft before you send it;
- check calendar events, notes and clean-up lists that KiQ AI prepares before you save or confirm them;
- tell us about a wrong or harmful answer, so we can look into it.
You are responsible for what is sent. Every email sent from your mailboxes is yours, whether you wrote it, approved a draft written by KiQ AI, or let it be sent automatically. If you switch on automatic replies, or connect KiQ AI+ agents that may send email, emails are sent in your name without you seeing each one first. You are responsible for them as if you had written them. Built-in limits reduce the risk of mistakes, but they cannot remove it. You can switch automatic replies and agents off at any time.
Email can try to trick AI. Emails can contain hidden text or instructions written to mislead an AI. We design KiQ AI to treat email content as information and not as instructions, but no protection is perfect.
No professional advice. KiQ Mail and KiQ AI do not give legal, financial, tax, medical or other professional advice. For decisions that matter, ask a qualified professional. Do not use KiQ AI output as the only basis for decisions that have legal or similarly significant effects on people, such as hiring or credit decisions.
AI providers. KiQ AI runs on AI models provided by other companies through our partners. The Privacy Policy names them. We may change the models we use, and the quality and style of answers may change with them.
Who owns the output. As between you and us, what KiQ AI writes for you belongs to you. It may not be unique, and others may receive similar output. You are responsible for using it lawfully, including telling people that a message was written by AI where the law requires it.
11. Acceptable use
You must not use KiQ Mail, or let anyone else use it, to:
- break the law, or help someone else break it;
- send spam, bulk email or marketing that the recipients did not agree to or that anti-spam law does not allow;
- phish, defraud, scam or mislead people, or impersonate a person or organisation;
- harass, threaten or abuse anyone, or promote violence or hatred;
- create, store or share any content that sexualises, exploits or endangers children;
- send malware, or attack, probe or overload any system;
- access mailboxes, accounts or data that you are not allowed to access;
- get around our plan limits, the KiQ AI allowance, security measures or technical limits, including by changing or tampering with our apps;
- copy, modify, reverse engineer or decompile KiQ Mail, except where the law allows it despite this restriction;
- collect data from KiQ Mail by automated means, or use KiQ Mail or its output to build a competing product or to train AI models;
- resell KiQ Mail or give others access to it without our written permission;
- infringe anyone's intellectual property, privacy or other rights.
We may investigate suspected misuse, and limit, hold back or remove content or access as section 16 explains.
12. Your content
- You keep all rights in your content.
- You give us a limited permission to store, copy, process, transmit and show your content only as needed to provide, secure and support KiQ Mail for you, and where the law requires it. This permission ends when the content is deleted, except for copies that remain for a short time in technical backups or that we must keep by law.
- You confirm that you have the rights and permissions needed for your content, including other people's personal data in your emails, contacts and calendar.
- If you use KiQ Mail for a business, Annex 2 explains how we handle the personal data of other people that your content contains.
- Some features create public links that anyone who has the link can open: pictures in your footers, your footer's "Save contact" vCard, your My Card link, and contact share links (which work for 3 days). You choose what to share, and you can switch these links off or delete them.
- We do not read your email as a matter of course. Your content is processed automatically to provide the Service. People at KiQ look at it only when you ask us to and allow it (for example for support), when it is needed to investigate a security problem or a serious breach of these Terms, or when the law requires it.
13. Services of other companies
- KiQ Mail works with services of other companies, such as your mail providers, Apple, Google, our payment provider Stripe, our AI partners, our email hosting provider and our hosting provider. We choose our partners with care, but we do not control them, and they can be unavailable or change how they work.
- Your use of your mail provider and of other services you connect is governed by your agreement with them.
- KiQ ID, KiQ Hub and the KiQ AI+ app are separate KiQ services with their own terms. The KiQ ID terms are at kiqid.app/terms.
- To the extent the law allows, we are not responsible for the acts, outages or changes of services that are not ours.
14. Availability and support
- We aim to keep KiQ Mail available at all times, but we do not promise any level of availability. We may interrupt it for maintenance, updates, security or reasons outside our control, and we try to keep such interruptions short.
- We give support by email at hello@kiqmail.app and through [support page URL]. We answer as soon as we reasonably can, but we do not promise a response time.
- We may ask you to install an update to keep using KiQ Mail, for example to fix a security problem. Older app versions may stop working.
15. Changes to KiQ Mail
- We may add, change or remove features for valid reasons, such as security, changes in the law, changes by our providers, or to improve KiQ Mail.
- If a change has more than a minor negative effect on a paid feature you use, we tell you clearly in advance, at least 30 days before it applies unless it is urgent for security or legal reasons. If you are a consumer, you can then end your plan free of charge within 30 days of the change or of being told about it, whichever is later, and we refund the price of the unused part of the period you paid for.
- We may stop offering KiQ Mail with at least 30 days' notice. We then refund the price of any paid period you cannot use.
16. Suspension and ending
You. You can stop using KiQ Mail at any time. You can delete your account in Settings on the web, iPhone, iPad, Mac or Android.
- Deleting your account first cancels your paid plan. If our payment provider cannot be reached at that moment, we ask you to try again a little later, so that you are never charged after deleting.
- Deleting removes your KiQ Mail account and its data as the Privacy Policy explains. It does not delete your KiQ ID, which other KiQ apps may use.
- A @kiqmail.net address stays reserved for a while after deletion, so nobody else takes it at once.
Us. We may limit features, suspend your account or end these Terms for you if:
- you seriously or repeatedly break these Terms;
- you do not pay;
- the law or an authority requires it;
- it is needed to prevent harm, fraud, abuse or a security risk, for example when your account or a mailbox appears to be compromised or is sending spam.
We act in proportion to the problem. Where we can, we warn you first. We tell you what we did and why, unless the law forbids it or it would undermine safety or an investigation, and you can ask a person to review the decision by writing to us. If we end your paid plan without fault on your part, we refund the price of the unused part of the period you paid for.
Inactive accounts. If an account has had no plan and no sign-in for 12 months, we may delete it after telling you by email at least 30 days before.
What survives. When these Terms end, your licence ends. Sections 12, 17, 18, 19, 20, 22 and 24 continue to apply as far as needed.
17. Ownership of the software and your licence
- KiQ Mail, including the apps, the web app, the servers, the design, texts, logos and look and feel, is the property of KiQ Limited, Ireland, or its licensors, and is protected by copyright and other intellectual property laws. KiQ Mail is software owned by KiQ Limited, Ireland. © 2026 KiQ Limited, Ireland. All rights reserved.
- We grant you a personal, non-exclusive, non-transferable licence, without the right to sublicense, to install the KiQ Mail apps on devices you own or control and to use KiQ Mail while you have an account, in line with these Terms. If you are a business user, you may use it for your internal business purposes. The software is licensed, not sold.
- You may not copy, modify, distribute, sell, rent or lend KiQ Mail, or remove our copyright or ownership notices. This does not limit what the law allows you to do regardless of these Terms, such as making a backup copy of an app or studying how it works.
- KiQ, KiQ Mail, the KiQ M@il logo, KiQ AI, KiQ AI+, KiQ Hub, KiQ ID and the orange ball mark are trademarks of KiQ Limited. You may not use them without our written permission.
- Some parts of KiQ Mail are open source software provided under their own licences. Those licences apply to those parts.
- If you send us ideas or feedback, we may use them freely, without any obligation to you.
18. Our promise about quality, and "as is"
- We provide KiQ Mail with reasonable care and skill.
- Apart from that, and to the extent the law allows, KiQ Mail is provided "as is" and "as available". We do not promise that it will be uninterrupted, free of errors or completely secure, that KiQ AI output will be accurate or complete, that every email will be fetched, synced, sent, delivered or kept, or that KiQ Mail will be fit for a particular purpose that we did not agree to.
- Your consumer rights. If you are a consumer, the law gives you rights when a digital service is not as described or does not work as it should, for example under the Consumer Rights Act 2022 in Ireland and the consumer law of your country. These may include having the problem fixed, a price reduction or ending the contract with a refund. Nothing in these Terms affects those rights.
19. Our liability
What we never limit. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that the law does not allow us to limit or exclude. Nothing in these Terms limits your mandatory consumer rights.
What we are not responsible for. To the extent the law allows, we are not responsible for loss or damage that results from:
- your mail provider, the internet, your devices, or other services that are not ours, including outages of AI, payment, hosting or push notification services;
- emails that are lost, delayed, duplicated, not fetched, not synced, not sent or not delivered because of something outside our reasonable control;
- settings, rules and automation that you switched on, and actions that you took or approved, including emails sent by automatic replies or agents you allowed;
- decisions that you or others make based on KiQ AI output, and drafts or suggestions that you used without checking them;
- content from others, such as the emails you receive;
- your not keeping backups, where a backup would have avoided the loss;
- someone using your account because you did not keep your sign-in details safe;
- events beyond our reasonable control, such as natural disasters, war, strikes, power cuts, large internet failures or attacks that we could not reasonably prevent.
No indirect losses. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, contracts, goodwill, opportunity or anticipated savings.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen, or if both of us knew it might happen when the contract was made. We provide KiQ Mail to consumers for domestic and private use, so we are not liable to consumers for business losses.
Our total liability. To the extent the law allows, our total liability to you for all claims arising out of or relating to KiQ Mail or these Terms, in any 12-month period, is limited to the greater of: the fees you paid us for KiQ Mail in the 12 months before the event that gave rise to the claim, or €50. This limit does not apply to the liability described under "What we never limit", and it does not reduce the remedies that consumer law gives you, such as a refund for a faulty service.
Business users. If you are a business user, any claim must be brought within one year of the date on which you became aware, or should have become aware, of it.
20. Indemnity for business users
If you are a business user, you agree to compensate KiQ for claims by third parties, and for the reasonable costs connected with them, to the extent they arise from your content, the emails sent from your mailboxes, the automation you switched on, or your breaking these Terms or the law. This includes, for example, claims about spam or unlawful marketing you sent, or about personal data you had no right to use. We will tell you about such a claim promptly and let you take part in defending it. This section does not apply to consumers.
21. Changes to these Terms
- We may change these Terms for valid reasons, such as new or changed features, changes in the law or in guidance from regulators, security, or to make the Terms clearer.
- For changes that matter to you, we tell you by email or in the app at least 30 days before they apply, unless a change is needed sooner to follow the law or to keep people safe. Small changes that do not affect your rights, such as corrections and clearer wording, may apply at once.
- KiQ Mail asks you to accept a new version before you continue. If you do not accept it, you can stop using KiQ Mail and cancel your plan. If you end your paid plan because of a change to these Terms that is to your disadvantage, we refund the price of the unused part of the period you paid for.
- The version date at the top shows which version applies. You can ask us for earlier versions.
22. Law and disputes
- These Terms are governed by the law of Ireland, and the courts of Ireland have jurisdiction.
- If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring proceedings in the courts of that country.
- If you have a complaint, please tell us first at hello@kiqmail.app. We aim to answer within 30 days. Consumers in Ireland can find information about their rights from the Competition and Consumer Protection Commission (www.ccpc.ie).
23. App store terms
If you downloaded a KiQ Mail app from Apple's App Store or Google Play, the following also applies:
- These Terms are between you and KiQ Limited only, not Apple or Google. KiQ Limited, not Apple or Google, is solely responsible for the app and its content.
- Your use of the app must also follow the rules of the store you got it from. For the App Store, Apple's standard Licensed Application End User License Agreement applies where these Terms do not cover a point, and your licence is limited to Apple branded devices that you own or control, as the App Store's usage rules allow. For Google Play, the Google Play Terms of Service apply.
- Apple and Google have no obligation to provide maintenance or support for the app. Support comes from us, as section 14 explains.
- If the app fails to meet any warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are KiQ Limited's responsibility, as far as these Terms and the law provide.
- KiQ Limited, not Apple or Google, is responsible for handling any claims by you or a third party about the app or your possession and use of it, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your possession and use of it infringes their intellectual property rights, KiQ Limited, not Apple or Google, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country that is subject to a United States government embargo or that the United States government has designated as a country supporting terrorism, and that you are not on any United States government list of prohibited or restricted parties.
- You must follow the terms of any third-party agreement that applies when you use the app, such as your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
- Questions, complaints or claims about the app go to us, at the contact details in section 25.

When you use KiQ Mail for a business, your content often contains personal data of other people, such as your customers, suppliers and contacts. For that data you are the controller, and KiQ processes it on your behalf as your processor, under Article 28 of the General Data Protection Regulation (GDPR). For that processing, KiQ:
- processes the data only on your documented instructions, which are these Terms, your settings and what you ask KiQ Mail to do, unless the law requires otherwise;
- makes sure that the people authorised to process it are bound by confidentiality;
- keeps it secure with appropriate technical and organisational measures;
- uses other processors (sub-processors) only under written terms that give the data the same level of protection, lists them in the Privacy Policy, and tells you in advance about changes so that you can object;
- helps you, as far as it reasonably can, to answer requests from people exercising their data protection rights, and to meet your obligations on security, breach notification and data protection impact assessments;
- tells you without undue delay after becoming aware of a personal data breach that affects your data;
- deletes the data when your account ends, unless the law requires us to keep it, and lets you take a copy before then where the Service offers it;
- gives you the information needed to show compliance with Article 28, and allows reasonable audits, at your cost and with reasonable notice.
You are responsible for having a lawful basis for the personal data you process with KiQ Mail and for informing the people concerned. For data about you as our customer, such as your account, plan and settings, KiQ is the controller, as the Privacy Policy explains.
